FBI’s Act Wears Thin: First Report on Ibragim Todashev Due Tomorrow

Ibragim TodashevTwo things amazed me about the killing of Ibragim Todashev: one, the ability of the FBI to hide the results of his homicide even though it occurred in an apartment controlled by police officers and the only witnesses to his killing were FBI agents and other law enforcement officers; and, despite my strong intent to write about it every month around the 22nd of the month, it had also slipped my mind. It wasn’t that I forgot about it; I didn’t. Rather the immediacy of the matter took second seat to other event and when it came back to mind it was usually far from the 22nd of the month. The FBI tactic of delay and obfuscation had even lulled me into forgetfulville.

I’d read the first reports that the FBI agent had been cleared in the shooting by the Florida State’s Attorney based on the usual unnamed sources. On March 21 the Washington Post’s headline was “Officials: FBI agent will be cleared in shooting of man connected to Boston bombing suspect.”  The DOJ and Florida State’s Attorney Jeffrey Ashton are supposed to do the clearing.

As for the DOJ clearing him that’s expected. In none of the killings of individuals by FBI agent has one ever been responsible for the homicide. One person commented on the story by stating:  “Well, I guess this preserves the FBI record of 100% of shootings being fully justified. That is every bit as reliable as a North Korean election.” To which another responded: “but less transparent.”

If the FBI thinks its act is going over well in America it should spend time reading the reaction of people to the act of its propaganda machine. Some of the many negative comments are: ”It would be nice to be able to believe this report, but the FBI’s history of deception makes it impossible; The level of incompetence displayed is astounding; the fix is always in. The dead guy could have been blind, in a wheel chair, and holding a cell phone, and the result would be the same;  Like Judge Dredd, the feds are empowered to arrest, sentence, and execute suspects at the scene of crime. Aren’t we at least supposed to pretend there is due process?; smells; Our government and the Russian gov’t are looking more the same every day”

But as for the State’s Attorney Ashton clearing the agent, well we don’t know about that yet. It seemed the information provided to the Washington Post, which Todashev’s attorney called  “amateurishly and irresponsibly leaked information” was denied by Ashton who said he had not reached any conclusion at that time.

The NY Times also wrote a story of similar effect based on information from “law enforcement officials. Googling the subject the “cut and paste” media were doing their utmost to spread the story of the FBI agent being cleared. But one newspaper decided to do a little extra work. It wasn’t a U.S. paper but the Guardian in London. It reported: “But the state attorney in Florida, Jeff Ashton, denied that he had come to the same conclusion. Ashton’s spokesman said he had completed his investigation but would make a final decision on how to proceed over the weekend.

Tomorrow we’ll know what’s really going on.  The Guardian reported:Ashton issued an angrily worded statement on Friday after media reports claimed he had decided not to charge the officer, saying the leaks on which they were based were “inaccurate and unfair”.  Why would Ashton be angry? Why did the anonymous law enforcement sources leak the information? Were they trying to force Ashton’s hand to bring him in line with the DOJ investigation? Is Ashton actually standing up to the pressure of the DOJ and FBI  and really conducting an independent investigation?

I’ve written about this in the past several times. I’m hoping the report will be complete and thorough. I’m waiting for the full report from Ashton prior to making any more comments. I only hope the FBI recognizes that despite if force of loyal agents and vaunted public relations machine its act is wearing thin.

    Still not sure Whether you are saying that the FBI already had a team or teams beating the brush or what’s left of it in Cambridge for the Tsarnaevs the night Officer Collier was shot, or that they responded with other law enforcement to that call. The implication that they had Tamerlane on the rolls and so knew where to look for him concurrent with the photo release does not fit with the notion of them aggrandizing themselves at the expense of competing agencies.

    If Tamerlane was their … Man In Dagestan … so to say, it seems they would have rolled him up long since after the bombings , before MIT and Watertown, and at the very least …. have kept him on ice . And that euphemism … is still going to take … an awful lot of sorting out !!!

      Yes, Wyshak seemed to think he ran the courtroom but as I’ve often said, Judge Casper could have sat Alan Dershowitz, Howie Carr and ten others of their soul mates including O’Neill and Lehr of the Globe on the jury and the case would still not be reversed. You must remember “due process” is a concept that varies with the subjects involved.

      I learned this a long time ago. I was in a conference with the First Circuit Court of Appeal judges in the appeal of the busing order entered by Judge Garrity. We were going over how the arguments on the appeal were going to be presented. I was talking about mine when one of the judges said to me: “Mr. Connolly, you have tu understand that there’s no way we are going to undo the orders of Judge Garrity relative to the busing.” In other words, the busing had already started and even if Garrity was totally wrong to undo his error would throw the City of Boston’s schools into a total uproar. So, in most cases the Court will try to bring about the right result but in some it will let it stand no matter how bad the lower court proceeding was. It might throw Brennan and company some bones but will not order a new trial and Whitey’s place of abode will not be changed.

      As for juror 12, she had a good lesson in civics. As for the engravings on the court house wall, they exist for the edification of the public. The judges who work in the courthouse never see them since they go in and out through a special entry.

    I raised the subject of that Akira Kurosawa movie Classic, Rashomon to you to start so we circle in meditative spirals on that one. I have to re-visit its Plot though to refresh recollection as to whether the percipient seven witnesses knew what they saw and adapted their versions to necessities of the moment in telling their memories, or simply, mis-remembered, or a combination of these. It is so Matt, right now I cannot completely remember although I think it was that they all lied while telling the truth in the telling and that is an amusing paradox for us to behold. I am curious now to examine the Plot again and observe while participating … how memory serves … its Master. 🙂

    As to Carmen Ortiz it may be useful to just observe that for the tens of thousands of really millions of causal moments that determined her Life’s course and place her now on Northern Ave. as United States Attorney only her Memory serves as honest Judge of whether she deserves to be there.     The FBI Teams in Cambridge that night ??? … What am I missing here??? … They’re all over the place anywhere, the quarry was on the move and so were the hunters . They did not have very far to go after all. Of deep fascination to me is mystery Tsarnaev witness ” Sammy” and his varying and various accounts now of his Satanic SUV Odyssey with the Tsarnaevs that abysmal night.       As for the FBI teams in Cambridge on the eve of the Shelter In – the FBI Director had ordered all resources to be devoted to looking for the terrorist bombers. He had 120 agents in DC going through film and video. The FBI said these teams were on a matter not related to the attack. Why would some FBI teams in the Boston office doing something that was not related to looking for those persons. Makes no sense. Everyone would have been doing the one thing; there would not have been teams out on an adventure of their own. I figure the FBI knew Tamerlan’s identity and went to grab him. You know how much they like to share publicity with others. In their attempt to outshine other law enforcement organizations, as is their wont, they screwed up and the Tsarnaevs went on their wild criminal run.

Very eloquently and accurately stated ! … Great book I read about ten years ago … BLINK : THE ART OF THINKING WITHOUT THINKING by Malcolm Gladwell the New Yorker writer was all about this ; the capacity for certain individuals, in his study, principally police officers, to keep their heads while all about them others, including in his study other particular offficers, are losing theirs. His jumpoff point is an analysis of that case around 2002-2003 ??? in Manhattan where the guy reaching for his own wallet in his apt.bldg doorway was … in a ” Kaleidoscopic ” … Love that word 🙂 … concatenation of deadly and unfortunate moments … was shot up and killed by a five man NYPD flying squad doing drug interdiction. He was Puerto Rican ethnically … I think they were Irish and Italian. All reacted individually , based on experience and there were widely varying degrees of culpability, but the result was this Guy’s death. Gladwell elaborates a whole thesis of what he considers the highly adaptive neurological/cognitive capacity for ” Thin Slicing ” an explosively rapid critical situation that a good experienced operator has developed versus a greener type of individual. I recommend it to you and Gladwell explains it quite well and persuasively.

    Carmen Ortiz is not a dullard. She is sharp, but politically ambitious. Methinks yon Carmen has that lean and hungry look Good Matt. I tend to keep an extremely close eye on such rawly ambitious people. She is also the kind of dark haired vixen I tend to keep a close eye on also … So there is that as well 🙂

    Yes … Jimmy Bulger is fearless and yes … Jimmy is a Serious Piece Of Work. The Appeal is going to surprise you I think Matt. Hank Brennan is a serious and committed advocate. Also the Tsarnaev Trial is going to create a hot crucible firing up a lot of FBI Iron . The crux of his Appeal is that the Old Village Smithy was one hell of a corrupt Forge !!!

      We all see and act differently in suddenly stressful events. Some people rise to the top and others collapse. We really don’t know what will happen until we encounter them and see what they bring out in us. There’s a Japanese movie that demonstrates how seven different witnesses to an event told seven different versions as to what happened with each one believeing he or she was telling the truth. Thus the unreliability of percipient witnesses encountering people for the first time.

      Ortiz is what she is – politically ambitious with nothing to bring to the table. Hardly a vixen – more one swimming about way over her head. Look at her background and you’ll see there’s not much there.

      Bulger’s appeal won’t surprise me – no court in America is gonig to want the circus to return to town. Brennan’s a good lawyer but no one has yet turned a sow’s ear into a silk purse. The FBI has pretty much put the Whitey embarrassment behind and is moving on – its only problem now is explaining why it sent teams of agents into Cambridge the night Officer Collier was murdered. It had been able to pass that off as not related but now that defense counsel has raised it in the case of the kid brother it can’t hide it anynmore.

  23. Matt : Brings it home more when you know the blood relation of a young man so tragically slain. Jake had a really good Grandson and the Kid had all the earmarks of a good Boston Irish Catholic kid. Yes, We both know folks who are bad to the bone Matt in particular OC Characters, specifically One who sits in Federal Prison in Tuscon on this very day. I was bemused and , as a fairminded fellow, infuriated by Carmen Ortiz’s use of the word and characterization ” Terrorist ” in connection with Jimmy Bulger post conviction. It was a calculated propaganda cheap shot from a person who is a Wise, but politically ruthless, Latina Woman in many reepects, in my basic estimation.

    Unlike the Tsarnaevs Jimmy Bulger never blew up kids, college students and maimed and disfigured innocent members of the Public. He is many things, but craven coward is not one of them. He put his safety up for grabs more than once in his ” Hands On Killer ” approach to his Hits, from what we are told. I also know he stood in the face of machine gun fire on at least one occasion and held his ground on a ” Hit”… Or so local legend has it I believe. Check that out for me would you Old Friend 🙂

    I got pretty rancorous in my remarks to Khalid consequently when he raised the possibilty of Tamerlane Tsarnaev’s ” Idealism ” as a motivation. Upon more measured reflection I remind myself that Khalid is an Intellectual, presents his views in a dignified and rational manner like the Gentleman we suspect him to be… And that I need not kill the Messenger … figuratively speaking … because I do not like the Message. My views regarding the ” Message ” of Tsarnaev Idealism and the notion of Tamerlane Tsarnaev as a passive FBI Puppet reacting to the carefully calculated ” Stressors ” of his Evil Empire Masters and … Snapping … remains the same. … BULLSHIT !!!

      Agree. Those who have been in situations like this know; them that sit home and speculate can’t grasp what is known. Perfect recall of traumatic events is rare, if not impossible. People see snatches of things – their eyes telling them one thing, their training another, their instincts still a third as everything around them twirls about in an impossible kaleidoscope even when gunfire is not present.

      With all due respect, I don’ think Ortiz is wise because everything she seems to do shouts out to me “dullard.” Her constant hyperbole ill suits one in her position. Her decisions surrounding the press confusion looks like she was more concerned with the media than doing her job. Her decisions in some cases speak of a high degree of ineptitude.

      Whitey, I almost called him Jimmy for which I would not forgive myself, was bad to the bone from the day he set foot on the earth which by the way happened to be the hottest September 3 in the history of record keeping which indicated to me at least a real hellion had arrived. I never doubted Whitey’s courage or capacity for evil. His fearlessness seemed well known.

      I believe lots of people have strange ideas some of which are far out but best go after those rather than them. Thanks.

    2. Tsarnaev killed because he was a radicalized anti-American. Add to it that his so-called ‘friends’ were Jewish and that further fueled his murderous intent despite having been ‘friends’ with them – 1. The three were Jewish 2. They were selling drugs 3. They were Americans. When he got away with those murders the radicalized anti-American Muslim then moved onto targeting random American people he did not know at all which he also symbolically chose to do so on a patriotic American holiday – many people forget that the marathon falls on Patriot’s Day and the Waltham murders were committed on the anniversary of 9/11. The assertion that Waltham was supposedly a robbery seems to be incorrect as the bodies were found with money and drugs strewn about them.

        Right on the money. Tamerlan hated America and had little regard for the lives of others. He planned to murder the three victims in Waltham from the beginning. I’m sur, as you suggest, that they were Jewish added to his motivation.

      I’m told Martin was the grandson of one of my buddies growing up, Jake. From what I know now Tamerlan seems an easy one to figure out. He was involved in the murder of three guys, one his friend from high school and gym mate, in a drug rip off (if Todashev is to be believed) and he slowly became more and more to hate things American. He was cute since he did not plan to be a suicide bomber but hoped he’d be able to pull this off like the triple homicide. He was bad to the bone as some people are as you well know; as for his brother – no tears shed here –

Perhaps, but, he could also have been under some intolerable pressure from his handlers, and, just snapped.       I don’t buy Tamerlan snapping because of something his handlers had done. From what it appears he seems to have become more and more radicalized as time passed. If Todasheve confessed, as it appears he did, to being at the murder with Tamerlan, then we can see that Tamerlan is a brutal man who has little problems with killing people. Add that into his radical militancy and it seems easy to see he set off the bombs prompted by his own sense of grandeur rather than any FBI agent messing him up.

    Good job. Keep digging. I think Todashev was Tsarnaev’s connection for pills down in Florida. Something happened, maybe snitching, maybe a rip-off, maybe both. The three guys killed were taken off the count for business reasons. The crime scene was deliberately made to look like an act of terrorism in hopes of misleading investigators. If there was snitching, Bredan Miess did the squeaking. His info led to Tsarnaev’s being pressured into becoming a Federal CI. Just before Tamerlane left on his government sponsored trip to Dagestan, he, and, Todashev, decided to visit the Waltham guys, and, clear accounts. Keep worrying at the pill angle. Everything will eventually unravel.

      Carrie presents a new look at things which adds to the picture. My sense of the triple murder in Waltham was that it had something to do with one of the deceased being an informant. If, as we are led to believe Todashev was there and he said he thought it was only going to be a robbery (this is on tape I thinnk) then the idea of the wipe out being related to an informant seems less tenable.

The only difference that may be telling though between the Wiretap and the Witness Interview is that in the former an unsuspecting suspect or suspects is eavesdropped upon and their words, unprompted by any but their own criminal muse, are the stark narrative. The Interview though if unrecorded offers the suspect an environment where a certain conversational give and play let’s … them … give and play !!! … Here, Truth may be teased out.   30. Susan Zalkind’s article and NPR interview on Todashev’s death and the murders of Weissman, Mess and Teken in Waltham shed llight on the Boston Marathon case to a very large national audience. Regular reporters are starting to ask questions about Wai Kru and the extraordinarily high number of deaths connected to the gym. Add Sammy Madarati and dirty Watertown cop George Diamond into the mix with an extra dash of Daniel Morley from MIT, and the FBI has a mess on its hands that no amount of cover up is going to fix. They will continue to unlawfully imprison and deport people that knew Todashev, and in Orlando they are now jailing people that happended to know a guy that knew a guy that knew Todashev. And what about the two FBI agents that were on the ground in Watertown, Lorek and Shaw? Nobody seems to remember how they fell out of that helicopter and sadly, nobody seems to care.     As you are aware Harvey Silverglate has railed and rallied against FBI refusal to record interviews . He has been beating this Defense Counsel war drum lustily, intelligibly to all who cherish Civil Liberties, and with the full flavor of his sardonic wit for several long years now. I believe the ACLU sponsored a video of his … WHAT TO DO IF THE FBI TRIES TO INTIMIDATE YOU … that is up on YOUTUBE. He has also written a good deal upon it.
    Matt, you long ago descried and decried the infernal control of the creative writing process that the Agent exercises writing up his 302 Witness Interview. It is irregular that just one Agent was present as the protocol for a division of labor with the traditional pair in the 302 gambit is that one actually interview and draw up the report and the other act as witness.
    I use the word gambit regarding the ” Interview ” very judiciously I hope. There is some very tangible investigative power and flexibility available to interviewer and interviewee when the interview is not recorded perhaps. There is some quality of playing by the book, but not inflexibly ruled by the book. In a World of bio and nuclear and leave it to some very diseased modern imaginations to create public horror like the Marathon Bombings, Threats ….. This sort of FBI flying high wide and handsome with some of their Investigative …. ” Techniques ” …. may be a necessary prophylactic if you will … however bruising to our ACLU sensibilities. I agree Matt, We shall most assuredly see when it all shakes out just what it is we know we are already looking directly at.

      Agree again, I’m not sure I like doing that. 🙂 There are times when you don’t want to record interviews. But I suggest those should be the exception and justified. Now it is the rule not to record them which makes no sense especially since an agent doesn’t need permission of the person being interviewed to do the recording. (one party consent is enough). He or she can sit there with a NAGRA or compatible device and take down word for word everything said. You know that is the required procedure during wiretaps – all must be recorded. We don’t trust the monitoring officer to write out a 302 after each conversation. The FBI after a wiretap always said the guy convicted himself with his own words but when it comes to outside a wiretap we have to rely on the FBI words. Harvey is right, the failure to record is a great wrong. In Todashev’s situation rather than having to get writing paper and pen if such thing happened, a smart FBI agent could easily have flipped on a tape recorder. Thanks.

  32. Understatement that a chain reaction and arguably some pronounced overreaction resulted in Mr. Todashev being killed. His fatal wounds particularly the top back of head are grisly, but consistent with being shot down upon by Agent or Agents unknown if he was, as alleged, attacking. The spectre of FBI and Massachusetts Staties performing some sort of Gangland style execution is absurd. If the intent was to execute by Government hit squad as it were it would have been done discreetly. There is an interesting issue as to nomenclature here and what in our Security on anabolic steroids Domestic Security Apparatus could actually be considered a Hit Squad, but leave that conversation for another time. It is presently still enough that we are not in the Argentina of the seventies Black Ford Falcon loads of Policia ” Disappearing” our citizens. Then it was off to the Naval Mechanic’s Building in downtown Buenos Aires to be tortured to death in leisurely fashion for your radical political beliefs. The final act in this tragedy was your corpse being lashed to a rusty railroad tie and dumped into the ocean from an army helicopter !!! … Yes… In the case of Mr. Todashev the act is wearing thin. But history reminds us of just how very thin the … Act… can really get … Seems like things just got Fubar … F***** Up Beyond All Recovery that night. I doubt we will never know the real reasons for this. The overarching home truth though is that they did not go into that apartment like a Dictator’s henchmen with the clear intention of assassinating this young and admittedly violent person. It is not a Perfect World in America these days. They screwed up procedurally and tactically. They screwed up. There is now the cover up of a screw up. And as Uncle Walter used to say …. ” And That’s The Way It Is ” … You know … It could be one Hell of a lot worse. Period

    1. McDonald, I’d have to agree, just a FUBAR, if it were anything more, you’d at least think they’d have been capable of covering their tracks better.

      You’re on the mark again. My problem has always been that the incident occurred in a contained environment where the only witnesses were law enforcement officers and it has taken over ten months to release a report which could easily have been done in a week. What happened was known within hours – there were no other facts to be gathered than those which existed at that time. The length of time it has taken is sure to have raised questions as they did with me. what was the reason for the delay. I’ve also lamented that we will never know the truth. One great problem the FBI has is its failure to record interviews. Imagine the value of a recording in this situation to set aside all the suspicion – it would be priceless. Now we have to rely on a well massaged report. One thing that is strange to me is that in my experience whenever an interview is conducted two FBI agents are there, here it is reported only one was; another is that usually local cops come along because it is their jurisdiction when people come in from out of state. Let’s see what is said.
